FACTORS AFFECTING NON-CONFERMENT OF NEW RECOGNIZANCE LAW FOR INMATES: BASIS FOR ENHANCEMENT

Abstract:

This study entitled “Factors Affecting Non-Conferment of Recognizance Law for Inmates: Basis for Enhancement” was conducted to determine the factors affecting the non-conferment of New Recognizance Law for inmates. The researcher utilized descriptive method to achieve this purpose. The researcher made use of purposive sampling in selecting the 138 respondents of the study. This was based on the assumption that they were the most qualified respondents of the study because they have the ability to give needed information about the factors affecting non-conferment of New Recognizance Law for inmates. The study revealed that the assessment of the gathered data concluded: In terms of demographic profile, most of the Inmate-respondents were 26-30 and 31-35 years old, male, high school undergraduate, single and married and have an income of below Php 5, 000.00. The inmates in Batangas Province committed violation of RA 9165 Sec. 11 also known as Possession of Dangerous Drugs. In the assessment of the respondents on the non-conferment of New Recognizance Law in terms of awareness of inmates in Lipa and Batangas City Jail, few made an initial step for them to avail recognizance while inmates in Tanauan City Jail, few had no disqualification for being applicant of New Recognizance Law. In the assessment of the respondents on the nonconferment of New Recognizance Law in terms of implementation of inmates in Lipa and Batangas City Jail, few already know that within 10 days the court would give a notification to the member of local government with regards on their application while inmates in Tanauan City Jail, few had filed a petition/motion to the court for the conferment of New Recognizance Law. Majority of the inmates in Batangas Province want to propose changes in the procedure for the conferment of New Recognizance Law. The assessment of the respondents on the factors affecting the non-conferment of New Recognizance Law has significant difference in terms of awareness and implementation. The assessment of the respondents on the factors for non-conferment of New Recognizance Law has significant relationship when grouped according to their age, highest educational attainment and socio-economic status. There is no significant relationship when grouped according to their sex, civil status and crime allegedly committed. Therefore, the researchers hereby recommended an action plan that should be utilized to enhance the awareness and implementation of conferment to New Recognizance Law. In terms of awareness, it includes the campaign information program, seminars for the relatives of inmates for the application for the New Recognizance Law and seminars for the inmates and in terms of implementation; it includes the monitoring policy, interpretation of implementing rules and regulation and Recognizance Desk Officers in all jails.
