Implementation Of Provincial Ordinance No. 016 Series 2017 Known as Public-Private Joint Venture in One Philippine Province

Abstract:

This study assesses the implementation of Provincial Ordinance No. 016 Series 2017, known as the Public-Private Joint Venture Ordinance, in Batangas Province, Philippines. The ordinance provides a legal framework for promoting a partnership between public and private sectors to address infrastructure and socio-economic challenges. The research focuses on assessing the ordinance's implementation, particularly in terms of projects and modalities, procedures, regulation, and accountability, while identifying problems encountered, such as stakeholder collaboration, risk management, and regulatory efficiency. Using a descriptive research design, data were collected from 380 department heads of local government units (LGUs) involved in Public-Private Partnership (PPP) projects through a validated survey instrument. Statistical analyses revealed that the ordinance is generally implemented, with the highest ratings for project initiation and execution but notable gaps in contract management and monitoring. Challenges included procedural inconsistencies and limited stakeholder engagement. Results demonstrated significant relationships between the effectiveness of ordinance implementation and the problems encountered, underscoring the need for robust governance mechanisms. The study proposes an action plan to enhance ordinance implementation, including improved risk allocation, stakeholder education, and systematic monitoring. Findings highlight the ordinance's potential to bridge infrastructure gaps, promote local development, and contribute to sustainable governance, offering insights for policymakers and practitioners seeking to optimize PPP strategies in similar contexts.
